Under the Land Registration Ordinance, from when does a registered charging order or lis pendens take priority?
Answer: From the day following the date of its registration. Why not the others: - From the date of the court order or writ: The Ordinance gives these court notices priority only from registration. - From the judgment date: A judgment creditor gains no priority over the land until a charging order is registered. - One-month back-dating: That rule in section 5 applies to ordinary instruments, not to charging orders or lis pendens.
