The landlord of a regulated subdivided unit asks the tenant for (i) a deposit of three months' rent, (ii) monthly rent, (iii) electricity charges at the apportioned actual cost, and (iv) a monthly 'management surcharge'. Which can he lawfully require?
Answer: (ii) and (iii) only. (i) Not allowed. The deposit is capped at two months' rent. (ii) Allowed. Rent is payable. (iii) Allowed. Utility charges may be reimbursed up to the apportioned amount set out in a written account. (iv) Not allowed. Other charges outside the permitted list cannot be demanded. Rule: Under Part IVA a landlord may take only rent, a deposit of no more than two months' rent, reimbursement of specified utility charges not exceeding the apportioned amount, and damages for breach.
