Mr Tsang, a non-permanent resident, bought a flat in 2025 and sells it in Oct 2026, 14 months later. Which of the following stamp duties apply to the 2026 sale and his 2025 purchase?
Answer: Only ad valorem stamp duty applies. Why not the others: - SSD within 24 months: SSD was withdrawn for instruments executed on or after 28 Feb 2024. - BSD on the 2025 purchase: BSD was also withdrawn from that date, so the 2025 purchase attracted none. - NRSD at 7.5%: Withdrawn on the same date. Rule: All residential demand-side management measures (SSD, BSD and NRSD) were withdrawn for instruments executed on or after 28 Feb 2024; ad valorem stamp duty still applies. Source: info.gov.hk press release 28 Feb 2024; IRD FAQ on demand-side management measures; as at Oct 2026
Applying SSD or BSD to transactions after 28 Feb 2024.
