The Chief Executive is considering appointing Mr Simon Yeung, a director of a large agency company who still does estate agency work, to the Estate Agents Authority. Which statement is correct?
Answer: ordinary member only. A person who does estate agency work (Category A) may be an ordinary member, but is not eligible to be Chairman or Vice-chairman. Why not the others: - Chairman if he declares interests: declaring interests is a duty of every member; it does not lift the bar on Category A persons chairing. - Cannot be appointed at all: the Schedule expressly provides for members who do estate agency work. - Vice-chairman only: the bar covers both the Chairman and the Vice-chairman; the public officer rule is unrelated. Rule: Category A (practitioners) may be ordinary members; the Chairman and Vice-chairman must come from outside the trade.
