Estate agent Mr Wan acts for the vendor. A provisional agreement is to be signed tonight. His land search is two weeks old. What does section 13 of the Practice Regulation require?
Answer: A land search immediately before signing, with a copy to the purchaser. Why not the others: - A month-old search is enough: The rule is 'immediately before'; registrations may have changed. - Only if asked: It is a duty, not on request. - A company search in every case: Needed only where the vendor is a company. Rule: The vendor's agent must carry out a land search immediately before the provisional agreement or lease is signed and supply a copy to the purchaser.
