On Monday 2 Nov 2026 estate agent Ms Lo accepts Mr Kwok's instructions to sell his flat. She plans to advertise it on Thursday 5 Nov, and a buyer may sign a provisional agreement the following week. By when must the Form 3 be signed?
Answer: Before she advertises on 5 Nov, because that is the earliest of the three triggers. Why not the others: - Within 7 working days regardless: The 7-working-day limit applies only if no earlier trigger arises. - Before the provisional agreement: Signing an agreement is a trigger, but advertising comes first here. - Within 14 days: There is no 14-day rule. Rule: On the vendor (or landlord) side, the estate agency agreement must be entered into within 7 working days after accepting instructions, or before advertising the property, or before the provisional agreement or lease is signed, whichever is the earliest.
