Kowloon Homes Agency gave Ms Tse a copy of her personal data in answer to an access request. She asks for her income figure to be corrected, and the agency agrees it is wrong. Four months ago the agency passed the figure, with her consent, to a bank for her mortgage application, and the bank is still using it. What must the agency do?
Answer: Correct the data within 40 days, give her a corrected copy, and take all practicable steps to give the bank a corrected copy with a written notice of the reasons. Why not the others: - The bank must ask: Where data was disclosed to a third party in the 12 months before the correction and the third party may still be using it, the data user must notify that party. - 14 days and a fee: The period is 40 days, and no fee may be charged for a correction request. - Cannot be corrected: Prior disclosure is the reason the third-party notice exists; it is not a bar to correction. Rule: A data user satisfied that data is inaccurate must, within 40 days, correct it, supply the requestor with the corrected copy, and take practicable steps to send it, with reasons, to any third party who received it in the preceding 12 months and may still be using it.
