Consider these statements about a partnership of two licensed estate agents, under section 16 of the Practice Regulation. (i) If one partner appoints a manager for the effective control of an office, both are treated as having complied. (ii) If one partner keeps proper accounts of client money, the other need not hold a valid licence. (iii) If one partner supplies the client with a copy of the executed estate agency agreement, both are treated as having complied. (iv) If one partner notifies the EAA that a salesperson has been employed, both are treated as having complied. Which statements are correct?
Answer: (i), (iii) and (iv) only. (i) True. Appointing a manager for the effective control of each office (EAO section 38(1)(a)) is covered. (ii) False. Section 16 does not cover accounts, and each partner must hold its own valid licence. (iii) True. Supplying copies of unexecuted and executed estate agency agreements (EAO sections 47 and 48) is covered. (iv) True. Notices of employment or cessation of employment of a salesperson, and of appointment or termination of a manager (EAO section 40(2) and (3)), are covered. Rule: For a partnership of licensed estate agents, the requirements under EAO sections 38(1)(a), 40(2) and (3), 47(1) and (2) and 48(1) and (2) are treated as complied with by each member if, but only if, at least one member complies.
