Mr Yip rents a three-bedroom flat in Sham Shui Po and wants to sublet one bedroom. He instructs Sunrise Realty to find a sub-tenant. What must Sunrise Realty’s advertisement for the bedroom expressly state under the Practice Regulation?
Answer: That the property is to be sublet. Why not the others: - The head landlord’s name: Not an advertising requirement; ownership details belong in the land search and information forms. - The rent under the head tenancy: Not required in the advertisement. - The expiry date of the head tenancy: Relevant information for the sub-tenant (Circular 01-09 (CR) asks agents to enter head-tenancy details in the Leasing Information Form), but not a statutory advertising requirement. Rule: A licensed estate agent shall not cause or permit an advertisement for a residential property which is to be sublet to be issued unless it expressly states that the property is to be sublet. Source: Practice Regulation (Cap. 511C), section 9(4); EAA Practice Circular No. 01-09 (CR); as at Oct 2026
Mixing up what goes in the advertisement with what goes in the Leasing Information Form.
