Simon Yip, a licensed salesperson, stops doing estate agency work on Monday 10 August 2026 to take up a job at a bank. He is not joining another agency. By what date must he notify the Estate Agents Authority, and on which form?
Answer: By Wednesday 9 September 2026, on Form 8. Working: The period is 31 days beginning on the date of cesser, so 10 August counts as day 1. 10 to 31 August = 22 days; 1 to 9 September = 9 days; 22 + 9 = 31. The last day is 9 September 2026. Why not the others: - 24 August on Form 9: 14 days is not the statutory period, and Form 9 is the employer's notice of employment or cessation of employment. - 9 September on Form 9: the date is right but the form is wrong; Simon's own notice of cessation is Form 8. (His employer separately files Form 9 for ending his employment.) - 10 November on Form 8: three months is far outside the 31-day period. Rule: A licensee who ceases to be engaged in estate agency work must notify the EAA in writing, on Form 8, before the 31-day period beginning on the date of cesser expires.
