A commission dispute of HK$150,000 is determined under Cap. 511D. Ignoring how the fee is split between the parties, what is the total determination fee, and how is the filing fee treated?
Answer: HK$15,000, with the filing fees deducted from it. Working: 10% × HK$150,000 = HK$15,000, which is above the HK$2,000 minimum. Why not the others: - HK$2,000: The minimum applies only where 10% would be lower. - HK$7,500: That is 5%, not the prescribed 10%. - HK$30,000: That is 20%. Rule: The determination fee is 10% of the total commission in dispute, subject to a minimum of HK$2,000; the filing fee (HK$500 per party) is deducted from it.
