Daniel Okafor is relocating to Hong Kong and asks Grace Yuen, a salesperson with Harbour Realty Limited, to find him a flat to rent in Tai Koo. Harbour Realty will act for Daniel. Which prescribed estate agency agreement must Harbour Realty enter into with him?
Answer: Form 6. It is the prescribed estate agency agreement for leasing residential property, used between an estate agent and a tenant. Why not the others: - Form 5: used with the landlord, the party letting the flat, not with the tenant. - Form 4: used with a purchaser in a sale, not with a tenant in a letting. - Form 2: the Leasing Information Form is an information form about the property; it is not an estate agency agreement. Rule: The Schedule to Cap. 511C prescribes Form 3 (vendor), Form 4 (purchaser), Form 5 (landlord) and Form 6 (tenant) as estate agency agreements; Forms 1 and 2 are the property and leasing information forms. Source: Estate Agents Practice (General Duties and Hong Kong Residential Properties) Regulation (Cap. 511C), s.3 and Schedule (Forms 2, 4, 5 and 6), as at Oct 2026
Candidates swap Form 5 and Form 6: Form 5 is signed with the landlord, Form 6 with the tenant.
