A purchaser under a provisional agreement wants to resell the flat before completion (as a 'confirmor'). The agency is asked to find a sub-purchaser. What should it make clear to the sub-purchaser?
Answer: That the seller is a confirmor dependent on the head agreement, and legal advice is needed. Why not the others: - Same as an ordinary sale: The confirmor does not yet own the flat. - The owner guarantees it: The original owner is not a party to the sub-sale. - No stamp duty: Sub-sales may be chargeable. Rule: EAA guidance on confirmor sales (Circular No. 01-08 (CR)) requires licensees to disclose the confirmor nature of the sale and its risks and to recommend legal advice; licensees must also disclose any interest of their own.
